What is the ONLY flag or pennant that may be flown above, or to the right (if on the same level as) the U.S. flag?

So if the USA was founded in 1776, when was the US flag officially adopted in the current form as seen today- albiet with less stars?

June 14, 1777, by the passing of the first Flag Act by congress.

Ok, here is the answer:

No other flag or pennant should be placed above or, if on the same level, to the right of the flag of the United States of America, except during church services conducted by naval chaplains at sea, when the church pennant may be flown above the flag during church services for the personnel of the Navy.

The flag as made today was set out in specifications in legislation from 1912. Until then there were no set rules for the exact layout.

"Executive Order of President Taft dated June 24, 1912 - established proportions of the flag and provided for arrangement of the stars in six horizontal rows of eight each, a single point of each star to be upward."
